1. About Pacer
Pacer Event Solutions Ltd. ("Pacer", "we", "us", or "our") is a company registered in the United Kingdom.
Pacer provides a modular software platform for mass-participation sporting events, including event registration, participant tracking, results publishing, and related tools.
2. Who may use the Services
You may use the Services if:
You are at least 18 years old, or have permission from a parent or legal guardian
You have authority to act on behalf of an organisation where applicable
You comply with these Terms and all applicable laws
Event organisers are responsible for ensuring their participants, volunteers, and spectators comply with applicable terms and event rules.
3. Accounts and access
Some parts of the Services require an account.
You agree to:
Provide accurate and complete information
Keep login credentials confidential
Notify us promptly of unauthorised access
You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that breach these Terms.
4. Role of Pacer
Depending on the context, Pacer may act as:
A service provider to event organisers
A data processor processing personal data on behalf of organisers
Pacer does not organise events, set race rules, or determine participant eligibility, unless explicitly stated.
5. Use of the Services
You agree not to:
Misuse the Services or interfere with their operation
Access systems or data without authorisation
Upload malicious code or harmful content
Infringe intellectual property rights
Use the Services for unlawful or fraudulent purposes
We reserve the right to monitor usage to ensure compliance.
6. Event content and accuracy
Event-related information (including results, timings, tracking data, and participant details) is provided by event organisers and timing partners.
While we aim to provide accurate and reliable Services:
Live data may be delayed, incomplete, or provisional
Results may change following verification
Pacer is not responsible for errors originating from third-party systems or data sources.
7. Payments and fees
Some Services are paid.
Where applicable:
Fees are agreed with organisers or partners
Payments are processed via third-party providers
Prices exclude VAT unless stated otherwise
Failure to pay may result in suspension of Services.
8. Intellectual property
All intellectual property rights in the Services, including software, designs, trademarks, and content (excluding event data owned by organisers), are owned by or licensed to Pacer.
You may not copy, modify, distribute, or reverse engineer any part of the Services without written permission.
9. User-generated content
You retain ownership of content you upload.
By uploading content, you grant Pacer a non-exclusive, worldwide licence to use, host, and display such content solely for the purpose of providing the Services.
You warrant that you have the right to upload the content and that it does not infringe third-party rights.
10. Availability and changes
We aim to provide reliable Services but do not guarantee uninterrupted availability.
We may:
Modify or discontinue features
Update the Services
Perform maintenance
We are not liable for downtime or loss caused by maintenance or changes.
11. Termination
We may suspend or terminate access:
For breach of these Terms
For non-payment
Where required by law
Upon termination, your right to use the Services will cease immediately.
12. Disclaimers
The Services are provided "as is" and "as available".
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law:
Pacer is not liable for indirect, incidental, or consequential losses
Pacer’s total liability arising from the Services shall not exceed the fees paid to Pacer in the 12 months preceding the claim
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.

You agree to indemnify and hold harmless Pacer from claims arising out of:
Your misuse of the Services
Breach of these Terms
Violation of applicable laws or third-party rights
15. Governing law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time.
Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
